i bought a 06 magnum from a dealer yesterday well needless to say i drove to work right afterwords after getting of from work and driving the car home the car would not shift into park nor any other gear so i was forced to put on the parking brake and shift of the car called aaa and the guy that came said i should be able to return the vehicle since it has not been even 12 hours since the purchase was made but my question is legally does the dealer have to fix or take back the car with it being less then even a day of me having it before it breaks down. got into contact with owner at first he stated that he will refund the money and then on second call he stats he will fix it and warrenty the part but now he wont refund the money at all...but i have him recorded saying he will so what are my options from there. in south Carolina by the way if that might help any

Happened to me before with the first car i ever purchased.

Unfortunately, being broke as i was, i didn't want to pay double what I had to for the insurance thing ($550), when the car itself was only $500.

fu*ked up sh*t, do some research for sure though and get your sh*t back.

i had the same gear shifting problem with my car a while back. Is it a 6-speed or automatic? Mine was a 6-speed and I had to add clutch/brake fluid and drain the clutch. If thats the only problem than its not hard to fix and has nothing to do with the engine or anything. If it happens again you may have a leak in the hose going from the clutch fluid. Little harder to fix but still not a big problem. On the other hand, if something else is wrong, you should do some research on the lemon law as stated above. I live in North Carolina and I'm pretty sure we don't have one because when I was getting some parts for my car in order to get it ready to sell, my mechanic told me I shouldn't do it because there is no lemon law and I should just tell who ever I sell it to that theres nothing wrong with it. South Carolina may be different though. Good Luck.

i learned in business law that you have rights. implied warrenty unless they told you "as is" or "with all faults". look up "warranty of merchantability." if you paid high dollar for a car, then it should perform as expected. doesnt not apply to cars that are a piece of sh*t with high milages. if the dealership doesnt take it back or fixes the problem, then sue.

um you go back they'll give you a brand new one...it's called the lemon law, if it happens 3 times within 90 days THEY HAVE TO REFUND YOUR MONEY OR GIVE YOU ANYTHING OF THAT VALUE YOU WANT that they selll...law=what you can do and what WILL happen...it happened to my dad like 8 years ago, and a few of my friends in the past years...it's actually funny unless it's you

CTR I suggest you start using spell check if you are claiming to take some business law classes(warranty). TIP2009 you seem to have a reading comprehension problem because he clearly states that the consumer has a valid case in regards of returning the car. One more question, exactly who would you hire for your business (some user on Itsbx.com obviously seems like the right choice)?

well if its an 06 it maybe still under factory warranty most manufacturers offer a 3yr/36000 mile warranty (which ever comes first) so look at the sticker on the inside of ur driver side door and look at the production date if its late 09 u should still be covered under the factory warranty

which would implicate it could possibly be used and due to our current economic treachery caused by the bilderberg group the FDIC, clinton and his douchebag friend Greenspan...a lot of companies aren't allowing transfering of warranties b/c it saves them a sh*tload of $ in the end...lemon law...get ur $ back and tell them to screw off...otherwise ur stuck...

FYI Implied Warranty of merchantability is the legal term for "lemon law."

sorry, you guys might have misunderstood me as being some know-it-all law school jerk. I’m not a law major. Business law is a gen. ed. class for all business majors; it's a rough overview of basic business law principles. I'm not pretending to know the law; I was only relaying my professor's (lawyer with 30+ years experience) lecture on consumer rights and business liabilities to help out a fellow boxden member. and sorry for misspelling the word "warranty." microsoft word ruined my spelling abilities a long time ago.

:iagree: Old American cars will last forever if you maintain them correctly, but new foreign cars will do the same over new American cars nowadays. American car builders are slowly catching up, though. Maybe we'll see American car builders back on top on our death beds. :rolllaugh:
